ADOPT A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO EXECUTE SECOND AMENDMENT TO THE CONSULTANT AND PROFESSIONAL SERVICES AGREEMENT BY THE BUILDING DIVISION WITH 4LEAF, INC. TO INCREASE CONTRACT FROM $150,000 TO $250,000 FOR CONTRACT BUILDING INSPECTION, BUILDING OFFICIAL, AND PLAN CHECK SERVICES

 

Staff is recommending that the City Council authorize the City Manager to execute the second amendment to the consulting services agreement with 4Leaf, Inc. to increase the contract amount from $150,000 to $250,000 to provide contract services for the Building Division.  This will add $100,000 to an ongoing contract.



BACKGROUND


Since October 1, 2018 the Senior Building/Code Compliance Inspector position has be vacant. As of March 31, 2019, the Building Official position has been vacant.  The Building Division has been utilizing contract staff from an external professional consulting firm to help out with construction inspections and Building Official duties until the positions are filled permanently.

 

On March 12, 2019, the City Manager executed the first amendment to the Consulting and Professional Services agreement with 4Leaf, Inc. not to exceed $150,000 for building inspection related services. The Building Division regularly uses contractual services on an as-needed basis to assist staff with plan reviews and contract staff for inspections of new buildings during periods of high construction activity and to supplemental staff when there are vacancies.  The City is now using 4Leaf, Inc. to provide Building Official services until the position is permanently filled. 

DISCUSSION

An essential component to economic development is the City’s ability to provide efficient, effective and timely development review and inspection services. Consultant agreements allow the Building Division access to external professional resources needed to conduct complex plan review and inspection services while adhering to the service timelines and to supplement staff during vacancies in the division. 

The revised contract agreement adds an additional $100,000 to the not to exceed amount of $250,000.  As noted, the agreement is for anticipated consultant staffing costs, including Code Compliance Inspector and Building Official, as well as plan check costs.  There is approximately $60,000 remaining in the current contract.  However, our contract with Lonell Butler (previous Building Official) has ended and 4Leaf is now providing the Building Official services.  Costs will continue to accrue until a Building Official and Code Compliance Inspector are permanently hired. Increasing the contract amount from $150,000 to $250,000 will allow for continued support of duties from consultants to City staff. This increase is essential in providing the Building Division an opportunity to maintain customer service while keeping consistency in plan review for projects and inspection services.

FISCAL IMPACT

There will be no impact to the General Fund as a result of the recommended actions.  Funding for contractual plan review, inspection and other permit related professional services, as described herein, will be covered by the salary savings of the currently vacant Building Official and Senior Building Inspector positions.



RECOMMENDATION

Staff recommends that the City Council adopt a resolution  to authorize the City Manager to execute the second Amendment to the Consultant and Professional Agreements with 4Leaf, Inc., Agreement No. C5255, and First Amendment C5305, amending the contract amount from $150,000 to $250,000.
